India's Insolvency Regulator Shields Healthy Real Estate Projects from Developer Insolvency
Mint · business
India's insolvency regulator, the IBBI, has introduced new rules allowing financially sound real estate projects to be shielded from bankruptcy proceedings against their developers. A committee of creditors can now recommend excluding individual projects from the Corporate Insolvency Resolution Process (CIRP) if the developer faces insolvency. This exclusion requires approval from creditors holding 66% of the voting share and clearance from the National Company Law Tribunal. The move aims to protect homebuyers from disruptions caused by defaults in other parts of a developer's portfolio, enhancing transparency and stakeholder interests.
