Tribunal: Property bought before offence can face attachment

The Appellate Tribunal under SAFEMA has ruled that property purchased before an alleged offence can still be attached if it represents the value of crime proceeds no longer available. This decision upheld the attachment of ₹41.5 lakh in a bank fraud case involving Chadalavada Infratech Ltd. The tribunal dismissed an appeal arguing the property was acquired prior to the offence. This ruling clarifies that the Prevention of Money Laundering Act allows attachment of equivalent-value property when direct proceeds are unavailable, subject to the criminal trial's outcome.
