सुप्रीम कोर्ट के जस्टिस दीपांकर दत्ता ने मौत की सज़ा के मामलों में न्यायपालिका की अत्यधिक नरमी पर चिंता जताई है। उन्होंने कहा कि इससे अपराधों में बढ़ोतरी हो सकती है। उन्होंने बताया कि निचली अदालतों ने एक दशक में 1,310 मौत की सज़ा सुनाईं, लेकिन हाई कोर्ट ने सिर्फ 70 को बरकरार रखा और सुप्रीम कोर्ट ने एक भी नहीं। जस्टिस दत्ता ने एक ऐसे मामले का जिक्र किया जिसमें एक बलात्कारी और हत्यारे को उम्रकैद की सज़ा मिली, जिसे बाद में पैरोल पर छोड़ दिया गया और उसने अपनी माँ की हत्या कर दी। जज ने तर्क दिया कि जघन्य अपराधों में भी अत्यधिक नरमी की एक सीमा होनी चाहिए ताकि अपराधों को रोका जा सके।
