Kerala HC Reserves Order on Prosecution Sanction

The Kerala High Court has reserved its order on whether state government prosecution sanction is required under the PC Act for alleged microfinance fraud involving SNDP Yogam office-bearers. The court heard arguments from the state government, which contended that the accused are private parties and not public servants, thus not requiring sanction. Previously, the vigilance investigation team had sought sanction.

केरल हाई कोर्ट ने एसएनडीपी योगम के पदाधिकारियों से जुड़े माइक्रोफाइनेंस धोखाधड़ी मामले में पीसी एक्ट के तहत राज्य सरकार की अभियोजन मंजूरी की आवश्यकता पर अपना फैसला सुरक्षित रख लिया है। कोर्ट ने राज्य सरकार की दलीलें सुनीं, जिसमें कहा गया कि आरोपी निजी व्यक्ति हैं, लोक सेवक नहीं, इसलिए मंजूरी की जरूरत नहीं है। इससे पहले विजिलेंस जांच टीम ने मंजूरी मांगी थी।
