Kappan Argues HC Lacks Jurisdiction Over Disqualification

Pala MLA Mani C. Kappan has contended that the Kerala High Court does not have the jurisdiction to hear a petition seeking his disqualification as a sitting MLA. He filed objections to a plea by businessman Dinesh Menon, who sought Kappan's removal following his conviction in cheque-bounce cases. Kappan stated that the Constitution designates the Governor, in consultation with the Election Commission, as the authority for disqualification matters.

मणि सी. कप्पन ने दलील दी है कि केरल हाई कोर्ट को विधायक के तौर पर उनकी अयोग्यता की अर्जी सुनने का अधिकार नहीं है। उन्होंने यह आपत्ति व्यापारी दिनेश मेनन की उस याचिका पर जताई है, जिसमें चेक बाउंस के मामलों में दोषी ठहराए जाने के बाद कप्पन को हटाने की मांग की गई थी। कप्पन ने कहा कि संविधान के तहत अयोग्यता के मामलों में राज्यपाल, चुनाव आयोग से सलाह-मशविरा करके, ही फैसला करने वाले अधिकारी हैं।
