Mother Not Entitled To Step-Son Maintenance: Court

The Allahabad High Court has ruled that a mother cannot claim maintenance from her step-son if she is already receiving it from her biological son. Justice Laxmi Kant Shukla stated that receiving maintenance from her real son makes her capable of self-maintenance. Therefore, she is not eligible for any further maintenance orders. This ruling clarifies legal provisions regarding maintenance claims within family structures in India.

इलाहाबाद हाई कोर्ट ने फैसला सुनाया है कि अगर माँ को अपने असली बेटे से गुजारा भत्ता मिल रहा है, तो वह सौतेले बेटे से इसकी मांग नहीं कर सकती। जस्टिस लक्ष्मी कांत शुक्ला ने कहा कि असली बेटे से गुजारा भत्ता मिलने पर वह खुद का भरण-पोषण करने में सक्षम है। इसलिए, वह किसी और से गुजारा भत्ता पाने की हकदार नहीं है। यह फैसला भारत में पारिवारिक ढाँचे के तहत गुजारा भत्ता के दावों को स्पष्ट करता है।
