Naming in Suicide Note Insufficient for Abetment Charge: Chhattisgarh HC

The Chhattisgarh High Court has ruled that simply naming an individual in a suicide note is not enough to prove abetment to suicide. Justice Naresh Kumar Chandravanshi upheld a lower court's decision to discharge an accused, stating that direct instigation or criminal intent must be proven. The court emphasized that matrimonial discord or family disputes alone do not establish abetment without evidence of criminal intent. This ruling clarifies that a suicide note reference cannot replace the legal requirements under Sections 306 and 107 of the IPC.

छत्तीसगढ़ हाई कोर्ट ने फैसला सुनाया है कि आत्महत्या के लिए उकसाने का आरोप साबित करने के लिए सिर्फ सुसाइड नोट में किसी व्यक्ति का नाम लिखना काफी नहीं है। जस्टिस नरेश कुमार चंद्रवंशी ने निचली अदालत के एक आरोपी को बरी करने के फैसले को बरकरार रखा और कहा कि सीधे उकसाने या आपराधिक इरादे को साबित करना होगा। कोर्ट ने इस बात पर जोर दिया कि वैवाहिक कलह या पारिवारिक विवाद अकेले आपराधिक इरादे के सबूत के बिना उकसाने का मामला नहीं बनाते हैं। इस फैसले से यह स्पष्ट होता है कि सुसाइड नोट का संदर्भ IPC की धारा 306 और 107 के तहत कानूनी आवश्यकताओं का स्थान नहीं ले सकता।
