Madras HC Questions MLA Resignation, Voter Rights

The Madras High Court observed that while elected MLAs have an absolute right to resign, the rights of voters cannot be violated. Justices S M Subramaniam and K Govindarajan noted that MLAs resigning and immediately contesting on another party's symbol presents a problem. The court directed the Election Commission of India to propose steps to protect voters' constitutional rights and explain guidelines for dealing with such resignations.

मद्रास हाई कोर्ट ने कहा कि विधायक इस्तीफ़ा दे सकते हैं, लेकिन वोटरों के हक़ नहीं छीने जा सकते। जजों ने कहा कि विधायक का इस्तीफ़ा देकर तुरंत दूसरी पार्टी से चुनाव लड़ना ठीक नहीं है। कोर्ट ने चुनाव आयोग को निर्देश दिया कि वोटरों के हक़ बचाने के लिए कदम उठाए जाएं और ऐसे इस्तीफ़ों से निपटने के लिए गाइडलाइंस बताई जाएं।
