The Supreme Court has reinforced the 24-hour rule for arrests, stating that any violation necessitates the immediate release of the accused. A bench led by Justice Ujjal Bhuiyan clarified that the 24-hour period begins from the time of detention, not formal arrest, making artificial distinctions invalid. Magistrates must now hear the detained person's side before deciding, not solely rely on police reports. Failure to comply can lead to departmental action, fines, or imprisonment for police personnel under the Bharatiya Nyaya Sanhita.
