The Madras High Court has ruled that a woman unaware of her husband's first marriage cannot be prosecuted for bigamy. Justice N Ramesh stated that only the spouse who remarries during a subsisting marriage is the offender under Section 82 of the BNS. The court allowed an anticipatory bail plea for Rajalakshmi, who was accused based on her partner's first wife's complaint.

मद्रास हाई कोर्ट ने कहा है कि अगर पत्नी को पति की पहली शादी के बारे में पता न हो, तो उस पर बहुविवाह का केस नहीं चलेगा। जस्टिस एन रमेश ने बताया कि भारतीय न्याय संहिता की धारा 82 के तहत, केवल वही व्यक्ति दोषी है जो मौजूदा शादी के दौरान दोबारा शादी करता है। कोर्ट ने एक महिला की अग्रिम जमानत याचिका मंजूर की, जिस पर उसके साथी की पहली पत्नी ने शिकायत की थी।
