Gujarat HC: Gratuity Cannot Be Withheld Over Pending FIR

Times of India · india

The Gujarat High Court has ruled that gratuity, a statutory retiral benefit, cannot be withheld solely due to a pending FIR. The court ordered the release of gratuity for a retired Aravalli district panchayat employee, stating that the allegations in the FIR were unrelated to his official duties or any loss to the government exchequer. Gratuity is earned over years of service and its withholding requires legal justification beyond mere criminal proceedings. The court emphasized that such benefits must be released within eight weeks.
