Chhattisgarh HC: Breach of Marriage Promise Not Always Rape

Times of India · india

The Chhattisgarh High Court has dismissed a woman's appeal against the acquittal of a 67-year-old man accused of sexual exploitation on the pretext of marriage. A division bench ruled that every breach of a marriage promise cannot be treated as rape, emphasizing that consent must be directly linked to a false promise. The court cited a Supreme Court ruling stating that sexual relations after a marriage promise constitute rape only if the promise was made solely to obtain consent without intent to fulfill it.
