Madras High Court: Police Must Serve the State, Not Ruling Party

The Hindu · india

The Madras High Court has strongly disapproved of police registering criminal cases against individuals criticising the ruling party. Justice N. Ramesh stated that police serve the enduring State, not the transient party in power, emphasizing impartiality. The court noted that police rarely file cases against ruling party members based on opposition complaints. These observations were made while granting anticipatory bail to a DMK Councillor accused of abusing the Chief Minister. The judge suggested criminal defamation is a more appropriate recourse than treating insults as public order crimes.
