Dowry Demand Proof Not Necessarily Documentary, MP High Court Rules

The Madhya Pradesh High Court has restored a husband's conviction for dowry harassment, stating that documentary proof of a prior agreement is not required to establish the offence. The court ruled that oral testimony can be sufficient to prove dowry demands made after marriage. Jewellery seized during the investigation was ordered to be returned to the woman, as it remained her exclusive property.

मध्य प्रदेश हाई कोर्ट ने दहेज उत्पीड़न के मामले में पति की सजा बहाल कर दी है। कोर्ट ने कहा कि अपराध साबित करने के लिए दहेज की मांग के किसी पिछले समझौते का दस्तावेजी सबूत जरूरी नहीं है। कोर्ट ने फैसला सुनाया कि शादी के बाद की गई दहेज की मांगों को साबित करने के लिए मौखिक गवाही काफी हो सकती है। जांच के दौरान जब्त किए गए गहनों को महिला को वापस करने का आदेश दिया गया, क्योंकि वे विशेष रूप से उसी की संपत्ति बने रहे।
