Personal law no exemption from POCSO: Delhi HC

The Delhi High Court has ruled that personal laws cannot exempt individuals from criminal liability under statutes like the POCSO Act. The court directed a man to face trial for sexual relations with his minor wife, stating that a marriage valid under Muslim personal law does not grant immunity. The bench emphasized that the age of consent, fixed at 18 by POCSO and the Bharatiya Nyaya Sanhita, is determinative. Personal laws may govern civil aspects of marriage but cannot override statutory protections for children.

दिल्ली HC: POCSO से व्यक्तिगत कानून को छूट नहीं

दिल्ली हाई कोर्ट ने कहा है कि व्यक्तिगत कानून किसी को POCSO जैसे कानूनों के तहत आपराधिक मामलों से नहीं बचा सकते। कोर्ट ने एक आदमी को उसकी नाबालिग पत्नी के साथ यौन संबंध के मामले में सुनवाई का सामना करने का आदेश दिया। कोर्ट ने साफ किया कि मुस्लिम व्यक्तिगत कानून के तहत मान्य विवाह भी POCSO से छूट नहीं दिला सकता। सहमति की उम्र 18 साल है, जो POCSO और भारतीय न्याय संहिता तय करती है। व्यक्तिगत कानून शादी के सिविल मामलों को देख सकते हैं, लेकिन बच्चों की सुरक्षा को ओवरराइड नहीं कर सकते।
