Supreme Court May Defer Ruling On Free Speech vs Legislative Privilege

The Supreme Court indicated on Monday that it might not examine the constitutional questions surrounding legislative privileges and freedom of speech for now. This is because the Tamil Nadu assembly resolution that led to the reference was withdrawn in 2004. Chief Justice of India Surya Kant suggested the seven-judge bench could dispose of the matter briefly, leaving larger questions for a future live controversy. Senior advocate Raju Ramachandran informed the court that the resolution's withdrawal made the issue academic.

सुप्रीम कोर्ट ने सोमवार को संकेत दिया कि वह फिलहाल विधायी विशेषाधिकारों और बोलने की आजादी से जुड़े संवैधानिक सवालों की जांच नहीं कर सकता है। ऐसा इसलिए है क्योंकि 2004 में तमिलनाडु विधानसभा का वह प्रस्ताव वापस ले लिया गया था जिसके कारण यह मामला भेजा गया था। भारत के मुख्य न्यायाधीश सूर्यकांत ने सुझाव दिया कि सात-न्यायाधीशों की पीठ इस मामले को संक्षेप में निपटा सकती है, और बड़े सवालों को भविष्य के किसी जीवित विवाद के लिए छोड़ सकती है। वरिष्ठ अधिवक्ता राजू रामचंद्रन ने अदालत को सूचित किया कि प्रस्ताव वापस लेने से यह मुद्दा अकादमिक हो गया था।
