MP High Court Refuses To Quash Rape FIR Against SBI Manager On Marriage Promise

The Madhya Pradesh High Court has dismissed a petition by a State Bank of India manager seeking to quash an FIR registered under Section 69 of the Bharatiya Nyaya Sanhita. The manager is accused of establishing physical relations with a woman colleague based on a promise of marriage. Justice Himanshu Joshi stated that determining the genuineness of the marriage promise requires evidence appreciation during trial. The court found that the FIR's allegations, taken at face value, prima facie disclosed the offence.

मध्य प्रदेश हाई कोर्ट ने भारतीय स्टेट बैंक के एक मैनेजर की याचिका खारिज कर दी है। मैनेजर FIR को रद्द करवाना चाहता था, जो भारतीय न्याय संहिता की धारा 69 के तहत दर्ज हुई थी। मैनेजर पर आरोप है कि उसने शादी का वादा करके एक महिला सहकर्मी के साथ शारीरिक संबंध बनाए। जस्टिस हिमांशु जोशी ने कहा कि शादी के वादे की सच्चाई का पता लगाने के लिए मुकदमे के दौरान सबूतों की जांच करनी होगी। कोर्ट ने पाया कि FIR में लगाए गए आरोप, पहली नजर में, प्रथम दृष्टया अपराध का खुलासा करते हैं।
