MP High Court Slams 'Reckless' Use of NSA Law

The Madhya Pradesh High Court has strongly criticised the "reckless invocation" of the National Security Act (NSA), calling it an "extraordinary constitutional measure" being treated as ordinary. A division bench ordered the release of two brothers, stating authorities failed to establish grounds for preventive detention and acted without applying their minds. The court noted the brothers had been acquitted in most cases when the NSA was invoked, indicating a lack of proper fact verification. The bench also expressed alarm at the speed with which the detention order was processed.

मध्य प्रदेश हाई कोर्ट ने राष्ट्रीय सुरक्षा अधिनियम (NSA) के "लापरवाह" इस्तेमाल की कड़ी आलोचना की है, इसे एक "असाधारण संवैधानिक उपाय" बताया जिसे आम माना जा रहा है। एक डिवीजन बेंच ने दो भाइयों की रिहाई का आदेश दिया, यह कहते हुए कि अधिकारियों ने निवारक हिरासत के लिए आधार स्थापित करने में विफल रहे और बिना सोचे-समझे काम किया। अदालत ने कहा कि जिन भाइयों पर NSA लगाया गया था, वे ज्यादातर मामलों में बरी हो गए थे, जो उचित तथ्य सत्यापन की कमी को दर्शाता है। बेंच ने हिरासत आदेश की प्रक्रिया की गति पर भी चिंता जताई।
