Supreme Court: Consensual Relations Post-Breakup Not Rape

The Supreme Court has clarified that consensual physical relationships cannot be termed rape after a breakup. A bench expressed concern over the misuse of law, where past events in ended relationships are presented as sexual harassment. The court emphasized that the legislature never intended for consensual sexual activities between adults in affectionate relationships to be criminalized retrospectively simply because the relationship ended. This ruling aims to prevent the exploitation of legal provisions in such cases.

सुप्रीम कोर्ट ने साफ किया है कि ब्रेकअप के बाद सहमति से बने शारीरिक संबंधों को रेप नहीं कहा जा सकता। एक बेंच ने कानून के दुरुपयोग पर चिंता जताई, जहां खत्म हुए रिश्तों की पिछली बातों को यौन उत्पीड़न के तौर पर पेश किया जाता है। अदालत ने जोर दिया कि विधायिका का इरादा कभी भी स्नेहपूर्ण रिश्तों में वयस्कों के बीच सहमति से यौन गतिविधियों को सिर्फ इसलिए पीछे से अपराधी बनाना नहीं था क्योंकि रिश्ता खत्म हो गया। इस फैसले का मकसद ऐसे मामलों में कानूनी प्रावधानों के शोषण को रोकना है।
