Spouse's Legal Actions Don't Justify Abandonment: Karnataka High Court

The Karnataka High Court has ruled that a spouse filing legal proceedings does not automatically constitute mental cruelty or justify abandonment. The court emphasized that such actions are permissible if there are justifiable grounds. This observation came while overturning a family court's decision that dismissed a wife's petition for restitution of conjugal rights. The bench noted that the husband had voluntarily abandoned his wife and sons in 2010 and cohabited with a former student, ceasing financial support.

कर्नाटक हाई कोर्ट ने फैसला सुनाया है कि पत्नी द्वारा कानूनी कार्रवाई करना अपने आप में मानसिक क्रूरता नहीं है और न ही यह पति को छोड़ने का आधार बन सकता है। कोर्ट ने जोर देकर कहा कि अगर जायज कारण हों तो ऐसी कार्रवाई की जा सकती है। यह टिप्पणी फैमिली कोर्ट के उस फैसले को पलटते हुए आई, जिसने पत्नी की वैवाहिक अधिकार बहाली की याचिका खारिज कर दी थी। बेंच ने कहा कि पति ने 2010 में स्वेच्छा से अपनी पत्नी और बेटों को छोड़ दिया था और एक पूर्व छात्रा के साथ रहने लगा था, और आर्थिक मदद भी बंद कर दी थी।
