Academician Apoorvanand Jha has approached the Supreme Court, arguing that authorities are using the concept of 'breach of peace' as a ploy for preventive detentions. He contends that equating peaceful protest with a breach of peace is unwarranted and prevents citizens from exercising their right to public demonstration. The Supreme Court has agreed to hear his petition, which challenges prohibitory orders under the Bharatiya Nagarik Suraksha Sanhita. Jha highlighted instances of preventive detentions, including minors, during protests demanding the resignation of Chief Election Commissioner Gyanesh Kumar.
