Illegal Mining on Patta Land is Fresh Offence, Double Jeopardy No Defence: HC

The Karnataka High Court has ruled that continued illegal mining, even on one's own land without permission, constitutes a fresh offence and cannot be defended by claims of double jeopardy. Justice V Srishananda dismissed a petition by Bhadrappa Lamani, who challenged Lokayukta proceedings for illegal ruby red granite mining. Lamani argued that a previous complaint meant a new case violated constitutional protections. The court clarified that double jeopardy protection applies only after a trial verdict, not for ongoing illegal activities.

कर्नाटक हाई कोर्ट ने फैसला सुनाया है कि अपनी जमीन पर भी बिना इजाजत लगातार अवैध खनन करना एक नया अपराध है और दोहरे दंड (double jeopardy) के दावे से इसका बचाव नहीं किया जा सकता। जस्टिस वी श्रीशानंदा ने भद्रप्पा लामणी की याचिका खारिज कर दी। लामणी ने अवैध रूबी रेड ग्रेनाइट खनन के लिए लोकायुक्त की कार्यवाही को चुनौती दी थी। लामणी का तर्क था कि पिछली शिकायत के चलते नया मामला संवैधानिक सुरक्षा का उल्लंघन करता है। कोर्ट ने साफ किया कि दोहरे दंड से सुरक्षा केवल मुकदमे के फैसले के बाद लागू होती है, न कि जारी अवैध गतिविधियों के लिए।
