Reserved Candidates Clearing Unreserved Cut-off Are Unreserved

The Lucknow bench of the Allahabad High Court has ruled that meritorious candidates from reserved categories who score above the unreserved cut-off must be treated as unreserved candidates. This decision applies at the screening stage if no relaxation was availed. The court found that the UP Public Services Act does not restrict this migration to the final selection stage. The bench set aside a condition in a UPPSC advertisement and directed the commission to review its office memorandum within three months.

इलाहाबाद हाईकोर्ट की लखनऊ बेंच ने फैसला सुनाया है कि आरक्षित श्रेणियों के मेधावी अभ्यर्थी जो अनारक्षित कट-ऑफ से ऊपर अंक लाते हैं, उन्हें अनारक्षित माना जाना चाहिए। यह फैसला स्क्रीनिंग चरण में लागू होता है यदि कोई छूट नहीं ली गई थी। कोर्ट ने पाया कि UP Public Services Act अंतिम चयन चरण में इस माइग्रेशन को प्रतिबंधित नहीं करता है। बेंच ने UPPSC विज्ञापन की एक शर्त को रद्द कर दिया और आयोग को तीन महीने के भीतर अपने कार्यालय ज्ञापन की समीक्षा करने का निर्देश दिया।
