Orissa HC Grants Default Bail in NDPS Case
Times of India · india
The Orissa High Court has ruled that the quantity of seized contraband and an accused's criminal history cannot negate their right to default bail if the chargesheet isn't filed within 180 days in an NDPS case. Justice V Narasingh granted bail to an accused possessing 320 grams of brown sugar, stating the investigating agency's failure violated Article 21. The court noted the statutory mandate was breached, as the matter wasn't even placed before the trial court for extension on the 180th day.
