Delhi HC: Disability Alone Cannot Deny Reproductive Autonomy

Business Standard · india

The Delhi High Court has ruled that disability cannot be the sole reason to deny reproductive autonomy or approve the removal of reproductive organs. Surgical intervention for such purposes requires medical expert recommendation that it is in the patient's best interest for welfare and dignity. The court made these observations while hearing a plea for a hysterectomy for a differently-abled woman unable to manage menstruation. It directed the formation of a multidisciplinary medical board to decide on the surgery within four weeks, clarifying this is not an automatic approval.
