Supreme Court Declines Academic Exercise on Legislative Privileges Issue

The Supreme Court stated it would not engage in an academic exercise regarding legislative privileges and freedom of speech. This decision came after the Tamil Nadu Assembly informed the court that a 2003 resolution, central to the case, was withdrawn in 2004. Chief Justice Surya Kant suggested proceeding only if the issue remains live, otherwise leaving the question open. Senior advocates Kapil Sibal and Solicitor General Tushar Mehta agreed with this approach. The bench asked for the resolution to be presented to a seven-judge bench for consideration.

सुप्रीम कोर्ट ने कहा कि वह विधायी विशेषाधिकारों और अभिव्यक्ति की स्वतंत्रता के संबंध में अकादमिक कवायद में शामिल नहीं होगा। यह निर्णय तमिलनाडु विधानसभा द्वारा अदालत को सूचित करने के बाद आया कि मामले के केंद्र में 2003 का एक प्रस्ताव 2004 में वापस ले लिया गया था। मुख्य न्यायाधीश सूर्य कांत ने सुझाव दिया कि यदि मुद्दा जीवित रहता है तो ही आगे बढ़ें, अन्यथा प्रश्न को खुला छोड़ दें। वरिष्ठ अधिवक्ता कपिल सिब्बल और सॉलिसिटर जनरल तुषार मेहता ने इस दृष्टिकोण से सहमति व्यक्त की। पीठ ने विचार के लिए प्रस्ताव को सात-न्यायाधीशों की पीठ के समक्ष प्रस्तुत करने को कहा।
