HC Cuts Accident Payout by Rs 4.92 Lakh, Applying Rajasthan Wages
Times of India · india
The Punjab and Haryana High Court has reduced a road accident victim's compensation from Rs 15.92 lakh to Rs 11 lakh. The court ruled that minimum wages from the victim's home state of Rajasthan should apply, as there was no proof of employment in Haryana. The Motor Accident Claims Tribunal had initially assessed the victim's monthly income based on Haryana's minimum wages for unskilled labour in 2021. The insurance company appealed this assessment, arguing Rajasthan's lower wage rate should be used.
