Bombay HC: Withholding Promotion Over Matrimonial Dispute Is Illegal

The Nagpur bench of the Bombay High Court has ruled that a pending criminal case stemming from a matrimonial dispute cannot be used to withhold an employee's promotion. The court quashed a decision by Mineral Exploration and Consultancy Ltd (MECL) to keep a senior manager's promotion result in a sealed cover. Justices Urmila Joshi-Phalke and Raj Wakode stated that such disputes, without allegations of service misconduct, corruption, or moral turpitude, are insufficient grounds to deny career advancement. This judgment protects the fundamental rights of central and semi-government employees.

बॉम्बे हाईकोर्ट की नागपुर बेंच ने फैसला सुनाया है कि वैवाहिक विवाद से जुड़े लंबित आपराधिक मामले का इस्तेमाल कर्मचारी के प्रमोशन को रोकने के लिए नहीं किया जा सकता। कोर्ट ने मिनरल एक्सप्लोरेशन एंड कंसल्टेंसी लिमिटेड (MECL) के एक वरिष्ठ प्रबंधक के प्रमोशन के नतीजे को सीलबंद लिफाफे में रखने के फैसले को रद्द कर दिया। जस्टिस उर्मिला जोशी-फाल्के और राज वाकौडे ने कहा कि सेवा में कदाचार, भ्रष्टाचार या अनैतिक आचरण के आरोपों के बिना ऐसे विवाद, करियर में उन्नति से इनकार करने के लिए अपर्याप्त आधार हैं। यह फैसला केंद्र और अर्ध-सरकारी कर्मचारियों के मौलिक अधिकारों की रक्षा करता है।
