Foreign Divorce Not Automatically Valid in India, Rules Supreme Court

The Supreme Court has ruled that a divorce granted by a foreign court is not automatically recognised in India. The apex court clarified that such foreign divorce decrees must meet Indian legal standards and conditions to be considered valid. This decision came while dismissing a plea from a man seeking to quash cases against him. He had argued that his second marriage was not bigamy after obtaining a divorce in Britain.

सुप्रीम कोर्ट ने फैसला सुनाया है कि किसी विदेशी अदालत द्वारा दी गई तलाक की डिक्री भारत में अपने आप मान्य नहीं होगी। शीर्ष अदालत ने साफ किया कि ऐसी विदेशी तलाक की डिक्री को मान्य माने जाने के लिए भारतीय कानूनी मानकों और शर्तों को पूरा करना होगा। यह फैसला एक ऐसे व्यक्ति की याचिका खारिज करते हुए आया है जो अपने खिलाफ मामलों को रद्द करने की मांग कर रहा था। उसने तर्क दिया था कि ब्रिटेन में तलाक लेने के बाद उसकी दूसरी शादी व्यभिचार नहीं थी।
