A division bench ruled that their detention is not illegal, as it is based on an administrative order pending deportation. The court noted that the husband's habeas corpus petition was dismissed because the administrative order, issued under the Immigration and Foreigners Act, remains in effect. The Gujarat government confirmed the woman is a Bangladeshi citizen and stated she is receiving necessary facilities during her detention.

गुजरात हाई कोर्ट ने भरूच में हिरासत में रखी गई एक बांग्लादेशी महिला और उसकी बच्ची को रिहा करने की याचिका खारिज कर दी है। एक डिविजन बेंच ने फैसला सुनाया कि उनकी हिरासत अवैध नहीं है, क्योंकि यह निर्वासन लंबित प्रशासनिक आदेश पर आधारित है। अदालत ने कहा कि पति की बंदी प्रत्यक्षीकरण याचिका खारिज कर दी गई थी क्योंकि आप्रवासन और विदेशियों अधिनियम के तहत जारी प्रशासनिक आदेश प्रभावी है। गुजरात सरकार ने पुष्टि की कि महिला बांग्लादेशी नागरिक है और कहा कि उसे हिरासत के दौरान आवश्यक सुविधाएं मिल रही हैं।
