Madras HC Refuses to Dismiss Plea Challenging Election of Resigned AIADMK MLA

The Madras High Court has refused to dismiss an election petition filed against the victory of Esakki Subaya, who previously served as an AIADMK MLA. Subaya had resigned his Ambasamudram MLA post and later joined the TVK party. He argued that the petition lacked specific allegations of inducement or gratification. However, Justice P B Balaji stated that the Supreme Court's ruling applies, and the petition cannot be rejected at the outset. The court emphasized that a case's potential weakness is not a reason to dismiss a petition before trial.

मद्रास हाईकोर्ट ने AIADMK के पूर्व विधायक एसक्की सुभया की जीत के खिलाफ दायर चुनाव याचिका को खारिज करने से इनकार कर दिया है। सुभया ने अम्बासमुद्रम से विधायक पद से इस्तीफा दे दिया था और बाद में TVK पार्टी में शामिल हो गए थे। उन्होंने तर्क दिया था कि याचिका में प्रलोभन या अनुतोष के विशिष्ट आरोप नहीं हैं। हालांकि, जस्टिस पी बी बालाजी ने कहा कि सुप्रीम कोर्ट का फैसला लागू होता है, और याचिका को शुरुआत में खारिज नहीं किया जा सकता। अदालत ने जोर देकर कहा कि किसी मामले की संभावित कमजोरी मुकदमे से पहले याचिका को खारिज करने का कारण नहीं है।
