Bombay HC Upholds Flat Cancellation Over Unpaid Stamp

The Bombay High Court has upheld a builder's decision to cancel the allotment of an Airoli flat due to the buyer's failure to pay stamp duty and registration charges. Justice Sandeep Marne set aside previous orders from MahaRERA and its Appellate Tribunal that had directed JP Builders and Developers to complete the sale. The court found that the buyer, Santosh Sandhu, had not actually paid the required charges, despite claiming to have deposited the money. The builder had cancelled the transaction on July 30, 2019, citing the buyer's financial difficulties.

बॉम्बे हाईकोर्ट ने खरीदार द्वारा स्टाम्प ड्यूटी और रजिस्ट्रेशन शुल्क का भुगतान न करने के कारण ऐरोली फ्लैट का आवंटन रद्द करने के बिल्डर के फैसले को बरकरार रखा है। जस्टिस संदीप मार्ने ने JP Builders and Developers को बिक्री पूरी करने का निर्देश देने वाले MahaRERA और उसके अपीलीय न्यायाधिकरण के पिछले आदेशों को रद्द कर दिया। अदालत ने पाया कि खरीदार, संतोष संधू ने पैसा जमा करने का दावा करने के बावजूद, आवश्यक शुल्क का भुगतान नहीं किया था। खरीदार की वित्तीय कठिनाइयों का हवाला देते हुए बिल्डर ने 30 जुलाई, 2019 को सौदा रद्द कर दिया था।
