HC Orders Railways To Pay ₹8 Lakh

The Allahabad High Court's Lucknow bench has ruled that the death of a foetus over five months old in a railway accident warrants separate compensation. The court ordered Indian Railways to pay an additional ₹8 lakh for the death of a seven-month-old foetus carried by a woman who died after falling from a train. The bench disagreed with the Railway Claims Tribunal, stating that the Railways Act's lack of specific mention of 'foetus' does not absolve them of liability.

इलाहाबाद हाई कोर्ट की लखनऊ बेंच ने फैसला सुनाया है कि रेलवे दुर्घटना में पांच महीने से बड़े भ्रूण की मौत पर अलग से मुआवजा मिलना चाहिए। कोर्ट ने इंडियन रेलवे को आदेश दिया है कि ट्रेन से गिरने से मरी महिला के सात महीने के भ्रूण की मौत के लिए ₹8 लाख अतिरिक्त दिए जाएं। बेंच ने रेलवे क्लेम्स ट्रिब्यूनल से असहमति जताते हुए कहा कि रेलवे एक्ट में 'भ्रूण' का जिक्र न होने से रेलवे की जिम्मेदारी खत्म नहीं होती।
