Casteist Slurs Online Invite Penal Action: Calcutta HC

The Calcutta High Court has ruled that casteist slurs posted on social media are subject to penal action. Justice Uday Kumar stated that the 'digital domain' falls under the ambit of 'public view' for the SC/ST (Prevention of Atrocities) Act. This observation came while directing police to reinvestigate a complaint from a Behala resident who was abused online due to his caste. The court criticised the police for filing a closure report without a thorough cyber-forensic probe, deeming it a miscarriage of justice.

कलकत्ता हाईकोर्ट ने फैसला सुनाया है कि सोशल मीडिया पर जातिवादी गालियां पोस्ट करने वालों पर कानूनी कार्रवाई होगी। जस्टिस उदय कुमार ने कहा कि 'डिजिटल डोमेन' भी SC/ST (अत्याचार निवारण) अधिनियम के तहत 'सार्वजनिक दृश्य' के दायरे में आता है। यह टिप्पणी उन्होंने बेहला के एक निवासी की शिकायत की दोबारा जांच करने का आदेश देते हुए की, जिसे उसकी जाति के कारण ऑनलाइन गाली दी गई थी। कोर्ट ने पुलिस की आलोचना की कि उन्होंने बिना पूरी साइबर-फोरेंसिक जांच के क्लोजर रिपोर्ट दाखिल कर दी, जिसे उन्होंने न्याय का हनन बताया।
