Haryana Tribunal Rescues 3 Gurugram Units From RERA Cancellation Order

The Haryana Real Estate Appellate Tribunal has overturned the cancellation of three units in Gurugram's M3M 65th Avenue project. The tribunal found that the promoter failed to provide the mandatory 90-day notice and grace period to buyers before cancelling their units for non-payment of dues. The cancellation order, issued on December 10, 2021, was deemed illegal and invalid. The tribunal directed the developer to hand over the units within 90 days, provided buyers clear their outstanding payments. This ruling protects buyers from arbitrary cancellations by developers.

हरियाणा रियल एस्टेट अपीलेट ट्रिब्यूनल ने गुरुग्राम की M3M 65th Avenue प्रोजेक्ट में तीन यूनिट्स का कैंसिलेशन पलट दिया है। ट्रिब्यूनल ने पाया कि प्रमोटर ने खरीदारों को बकाया भुगतान न करने पर उनकी यूनिट्स को कैंसिल करने से पहले अनिवार्य 90-दिन का नोटिस और ग्रेस पीरियड नहीं दिया था। 10 दिसंबर, 2021 को जारी कैंसिलेशन ऑर्डर को अवैध और अमान्य माना गया। ट्रिब्यूनल ने डेवलपर को खरीदारों द्वारा बकाया भुगतान क्लियर करने पर 90 दिनों के भीतर यूनिट्स सौंपने का निर्देश दिया है। यह फैसला खरीदारों को डेवलपर्स द्वारा मनमाने कैंसिलेशन से बचाता है।
