SC/ST Act Case Needs More Than Just Caste Identity, Rules Allahabad HC

The Allahabad High Court has clarified that a case under the SC/ST Act cannot proceed solely based on the complainant's caste identity. The court emphasized that for an offense to be registered, the allegations must clearly indicate that the accused intentionally used caste-based slurs or engaged in insulting behavior motivated by caste. Justice Santosh Rai passed this order while hearing an appeal related to an FIR filed in Siddharthnagar district.

SC/ST एक्ट मामले में सिर्फ जाति पहचान से ज़्यादा ज़रूरी, इलाहाबाद HC का फैसला

इलाहाबाद हाई कोर्ट ने साफ़ किया है कि SC/ST एक्ट के तहत कोई मामला सिर्फ शिकायतकर्ता की जाति पहचान के आधार पर आगे नहीं बढ़ाया जा सकता। कोर्ट ने इस बात पर ज़ोर दिया कि कोई अपराध दर्ज करने के लिए, आरोपों में साफ़ तौर पर यह दिखना चाहिए कि आरोपी ने जानबूझकर जाति-आधारित गालियाँ दीं या जाति से प्रेरित अपमानजनक व्यवहार किया। जस्टिस संतोष राय ने सिद्धार्थनगर जिले में दर्ज FIR से जुड़ी एक अपील पर सुनवाई करते हुए यह आदेश दिया।
