Karnataka HC Faults Trial Court on Pardon Report

The Karnataka High Court has criticized a trial court for seeking a Probation Officer's report before granting pardon to an accused in the Renukaswamy murder case. Justice M. Nagaprasanna directed the trial court to issue a fresh order on the pardon plea without considering the PO's report. The High Court clarified that other accused, including actor Darshan, can only challenge procedural errors, not the pardon's merit.

कर्नाटक हाईकोर्ट ने माफ़ी रिपोर्ट पर ट्रायल कोर्ट को फटकारा

कर्नाटक हाई कोर्ट ने ट्रायल कोर्ट को फटकार लगाई है। कोर्ट ने कहा कि रेणुकास्वामी हत्या मामले में आरोपी को माफ़ी देने से पहले प्रोबेशन ऑफिसर की रिपोर्ट नहीं मांगी जानी चाहिए थी। जस्टिस एम. नागप्रसन्ना ने ट्रायल कोर्ट को आदेश दिया कि PO की रिपोर्ट को नज़रअंदाज़ कर माफ़ी की अर्ज़ी पर नया फैसला दें। हाई कोर्ट ने यह भी साफ किया कि एक्टर दर्शन सहित अन्य आरोपी सिर्फ प्रक्रियात्मक गलतियों पर सवाल उठा सकते हैं, माफ़ी के गुण-दोष पर नहीं।
