The Chhattisgarh High Court has ruled that government employees facing even minor penalties must be given an opportunity to respond to allegations before action is taken. Justice Bibhu Datta Guru quashed an order withholding an annual increment for an assistant draftsman, stating that Rule 16(1)(a) of the Chhattisgarh Civil Services Rules, 1966, cannot be ignored for minor penalties. The court emphasized that mandatory safeguards must precede any penalty, rejecting the argument that a subsequent representation could rectify the procedural lapse. The disciplinary authority can proceed afresh if legally permissible.

छत्तीसगढ़ हाई कोर्ट ने कहा है कि सरकारी कर्मचारियों पर छोटी सी भी कार्रवाई से पहले उन्हें अपना पक्ष रखने का मौका मिलना चाहिए। जस्टिस बिभू दत्ता गुरु ने एक सहायक ड्राफ्ट्समैन के वार्षिक वेतन वृद्धि रोकने के आदेश को रद्द कर दिया। उन्होंने कहा कि मामूली दंड के लिए छत्तीसगढ़ सिविल सेवा नियम, 1966 के नियम 16(1)(a) को नज़रअंदाज़ नहीं किया जा सकता। कोर्ट ने ज़ोर दिया कि कोई भी सज़ा देने से पहले ज़रूरी सुरक्षा उपाय होने चाहिए।
