Madras HC Quashes Detention Under Goondas Act

The Madras High Court has quashed the detention of B.T. Arasakumar, president of an unregistered private schools association, under the Goondas Act. Arasakumar was accused of illegally collecting over ₹100 crore from school managements. The court cited a delay in considering his representation against detention as the primary reason for the quashing. The court also noted that his alleged actions did not threaten public order, a prerequisite for invoking the Act. His wife had filed a habeas corpus petition challenging the detention.

मद्रास हाईकोर्ट ने एक गैर-पंजीकृत निजी स्कूल एसोसिएशन के अध्यक्ष बी.टी. अरसकुमार की गुंडा एक्ट के तहत गिरफ्तारी रद्द कर दी है। अरसकुमार पर स्कूल प्रबंधन से ₹100 करोड़ से ज़्यादा अवैध रूप से वसूलने का आरोप था। कोर्ट ने गिरफ्तारी के खिलाफ उनकी अर्ज़ी पर विचार करने में हुई देरी को रद्द करने का मुख्य कारण बताया। कोर्ट ने यह भी कहा कि उनके कथित कामों से सार्वजनिक व्यवस्था को खतरा नहीं था, जो इस एक्ट को लागू करने के लिए ज़रूरी है। उनकी पत्नी ने गिरफ्तारी को चुनौती देते हुए बंदी प्रत्यक्षीकरण याचिका दायर की थी।
