Allahabad HC Declares Arrest Unlawful, Orders FIR Against IO

The Allahabad High Court has declared the arrest of a petitioner unlawful and ordered his immediate release. The court directed the Superintendent of Police in Farrukhabad to register an FIR against the investigating officer. This action was taken after the court found that additional particulars regarding the reasons for arrest were inserted subsequently into the arrest memo. The bench observed that the investigating officer appeared to have committed an offense under the Bharatiya Nyaya Sanhita for fabricating evidence and denying the petitioner relief.

इलाहाबाद हाई कोर्ट ने एक याचिकाकर्ता की गिरफ्तारी को गैरकानूनी घोषित कर दिया है और उसे तुरंत रिहा करने का आदेश दिया है। कोर्ट ने फर्रुखाबाद के पुलिस अधीक्षक को जांच अधिकारी के खिलाफ FIR दर्ज करने का निर्देश दिया है। यह कार्रवाई तब की गई जब कोर्ट ने पाया कि गिरफ्तारी के कारणों के बारे में अतिरिक्त विवरण बाद में गिरफ्तारी मेमो में डाले गए थे। बेंच ने देखा कि जांच अधिकारी ने सबूत गढ़ने और याचिकाकर्ता को राहत से वंचित करने के लिए भारतीय न्याय संहिता के तहत अपराध किया है।
