Umar Khalid, Sharjeel Imam Challenge Delhi HC's Bail Refusal in Supreme Court

Jailed activists Umar Khalid and Sharjeel Imam have approached the Supreme Court challenging the Delhi High Court's September 30 order that denied them bail in the 2020 Delhi riots larger conspiracy case. Both argue they should be granted bail as the prosecution has failed to examine a single witness despite their prolonged custody. The High Court had previously stated it was bound by a Supreme Court order allowing them to seek bail again only after witness examination or one year, whichever came first.

जेल में बंद एक्टिविस्ट उमर खालिद और शरजील इमाम ने 2020 के दिल्ली दंगों की बड़ी साजिश के मामले में जमानत देने से इनकार करने वाले दिल्ली हाई कोर्ट के 30 सितंबर के आदेश को सुप्रीम कोर्ट में चुनौती दी है। दोनों का तर्क है कि उन्हें जमानत मिलनी चाहिए क्योंकि लंबी हिरासत के बावजूद अभियोजन पक्ष एक भी गवाह की जांच कराने में विफल रहा है। हाई कोर्ट ने पहले कहा था कि वह सुप्रीम कोर्ट के उस आदेश से बंधा है, जिसमें उन्हें गवाहों की जांच या एक साल, जो भी पहले हो, के बाद ही जमानत के लिए फिर से आवेदन करने की अनुमति दी गई थी।
