Supreme Court Rules Death Penalty Only If Convict's Reformation Is Ruled Out

The Supreme Court has ruled that capital punishment can only be imposed when the possibility of a convict's reformation is completely ruled out. The court emphasized that the prosecution must prove life imprisonment is unquestionably inadequate as an alternative. This principle was applied when the bench commuted a death sentence for a man convicted of child rape and murder. The court noted that the prosecution failed to establish the convict was beyond reform, and his background and conduct in custody weighed against such a conclusion.

सुप्रीम कोर्ट ने फ़ैसला सुनाया है कि मौत की सज़ा सिर्फ़ तभी दी जा सकती है जब किसी दोषी के सुधरने की संभावना पूरी तरह से ख़त्म हो जाए। कोर्ट ने ज़ोर दिया कि अभियोजन पक्ष को यह साबित करना होगा कि उम्रकैद एक अविश्वसनीय विकल्प है। इस सिद्धांत को तब लागू किया गया जब बेंच ने एक बच्चे के साथ बलात्कार और हत्या के दोषी को मौत की सज़ा को उम्रकैद में बदल दिया। कोर्ट ने कहा कि अभियोजन पक्ष यह साबित करने में नाकाम रहा कि दोषी सुधरने से परे है, और उसकी पृष्ठभूमि और हिरासत में उसके आचरण ने ऐसे निष्कर्ष के ख़िलाफ़ वज़न डाला।
