Minor Election Paper Defects Not Improper Acceptance, Tamil Nadu CM Tells High Court

Tamil Nadu Chief Minister C Joseph Vijay argued before the Madras High Court that minor defects in election affidavits do not constitute improper acceptance and should not lead to an election petition trial. He stated that nearly all details, including assets and income, were disclosed, and factual errors do not invalidate his nomination. His counsel contended that the petitioner failed to plead how any alleged improper acceptance materially affected the election result. The court heard these arguments opposing a plea challenging Vijay's election from the Perambur assembly constituency.

तमिलनाडु के मुख्यमंत्री सी जोसेफ विजय ने मद्रास हाई कोर्ट में दलील दी कि चुनाव हलफनामों में छोटी-मोटी खामियों को गलत स्वीकृति नहीं माना जा सकता और इससे चुनाव याचिका पर सुनवाई नहीं होनी चाहिए। उन्होंने कहा कि लगभग सभी विवरण, जिसमें संपत्ति और आय शामिल है, बताए गए थे और तथ्यात्मक त्रुटियां उनके नामांकन को अमान्य नहीं करतीं। उनके वकील ने तर्क दिया कि याचिकाकर्ता यह साबित करने में विफल रहा कि कथित गलत स्वीकृति ने चुनाव परिणाम को कैसे महत्वपूर्ण रूप से प्रभावित किया। कोर्ट ने पेराम्बुर विधानसभा क्षेत्र से विजय के चुनाव को चुनौती देने वाली याचिका के विरोध में ये दलीलें सुनीं।
