Madras HC Rules Against Sisters in Property Dispute Over Parents' Estate
Times of India · india
The Madras High Court has ruled against two sisters seeking a share in their parents' properties, upholding their brother's claim. The mother owned 12 properties and died intestate in 1991, while the father made a Will in 2005 for his 26 properties, but a procedural error invalidated it. The sisters claimed one-third each under Hindu Succession Law after their father's death in 2009. However, the court cited the brother's exclusive control over the land and the sisters' nearly 18-year delay in seeking partition as key factors in its decision.
