Indiana Homeowner Loses Appeal Over Shared Garden Vandalism
Times of India · interesting
An Indiana homeowner's appeal against an injunction preventing damage to shared garden areas has been denied by the Indiana Court of Appeals. Martin L. Booth had cut shrubs, trampled flowers, and damaged landscaping lights, claiming it was routine maintenance. The Efroymson House Owner’s Association argued that Booth vandalized common areas designated by the HOA's covenants. The court found sufficient evidence that the association controlled the landscaping and had a reasonable likelihood of success in its vandalism claim, allowing the injunction to stand.
