Niva Bupa Sued Social Media Influencer Vishal Rattewal For ₹5 Crore Damages

Niva Bupa Health Insurance Company Limited sought ₹5 crore in damages from CA and social media influencer Vishal Rattewal over allegedly disparaging posts. The insurer claimed Rattewal's online content, posted in connection with a consumer complaint, damaged its reputation and used its trademarks. The Delhi High Court, however, imposed a token cost of ₹1 on Niva Bupa, ruling the dispute was not maintainable before its Intellectual Property Division. The court stated that using the company's name to identify it did not constitute trademark infringement in this context.

निवा बूपा हेल्थ इंश्योरेंस कंपनी लिमिटेड ने सीए और सोशल मीडिया इन्फ्लुएंसर विशाल रतेवाल से कथित तौर पर अपमानजनक पोस्ट के लिए ₹5 करोड़ के हर्जाने की मांग की। बीमा कंपनी का दावा था कि रतेवाल की ऑनलाइन सामग्री, जो एक उपभोक्ता शिकायत के संबंध में पोस्ट की गई थी, ने उसकी प्रतिष्ठा को नुकसान पहुंचाया और उसके ट्रेडमार्क का इस्तेमाल किया। हालांकि, दिल्ली हाई कोर्ट ने निवा बूपा पर ₹1 का सांकेतिक जुर्माना लगाया, यह कहते हुए कि यह विवाद उसकी बौद्धिक संपदा प्रभाग के समक्ष सुनवाई योग्य नहीं था। अदालत ने कहा कि कंपनी के नाम का उपयोग उसे पहचानने के लिए करना इस संदर्भ में ट्रेडमार्क उल्लंघन नहीं था।
