Karnataka HC: Registrar of Societies Cannot Settle Private Disputes Among Club Members

The Hindu · india

The Karnataka High Court has ruled that the Registrar of Societies cannot adjudicate private civil disputes between members of registered clubs. Justice Suraj Govindaraj issued guidelines stating the Registrar's statutory power under Section 25 of the KSR Act is for examining a society's constitution and finances, not for resolving management control disputes. While the Registrar can investigate financial irregularities, they cannot act as a civil court. The court also cautioned against parallel adjudication of issues already pending before civil courts, though genuine financial enquiries are permitted.
