RBI Mandates Upfront MTM Exchange on OTC Derivatives

The Reserve Bank of India has clarified that the mark-to-market value of over-the-counter derivative contracts must be exchanged upfront during novation. This rule applies to new and existing contracts after the issuance date. The central bank also expanded the definition of a "remaining party" to include market makers or central counterparties. However, novations by CCPs for settlement purposes are exempt, though subsequent novations will follow the new directions.

भारतीय रिज़र्व बैंक ने साफ किया है कि ओवर-द-काउंटर डेरिवेटिव कॉन्ट्रैक्ट्स के मार्क-टू-मार्केट वैल्यू का भुगतान नोवेशन के समय तुरंत करना होगा। यह नियम नए और मौजूदा कॉन्ट्रैक्ट्स पर लागू होगा। RBI ने "शेष पार्टी" की परिभाषा में मार्केट मेकर्स या सेंट्रल काउंटरपार्टी को भी शामिल किया है। हालांकि, सेटलमेंट के लिए CCPs द्वारा किए गए नोवेशन पर यह नियम लागू नहीं होगा, लेकिन बाद के नोवेशन पर नई दिशाओं का पालन करना होगा।
