Madras HC Rules Assigned Panchami Land Can Be Reallotted After Cancellation

The Madras High Court has ruled that once an assignment of government Panchami land is terminated or frustrated by the assignee's actions, it reverts to its original status as government 'tharisu' land. This makes the land available for fresh allotment or public distribution according to law. Justice Krishnan Ramasamy noted that while the land was allotted to Scheduled Caste (SC) individuals with a restriction against alienation to non-SC/ST persons, this condition was breached.

मद्रास हाई कोर्ट ने फैसला सुनाया है कि एक बार सरकार की पंचमी जमीन का आवंटन असाइनी के कामों से खत्म या विफल हो जाने पर, यह सरकार की 'थारिसु' जमीन के रूप में अपनी मूल स्थिति में वापस आ जाती है। इससे कानून के अनुसार नई आवंटन या सार्वजनिक वितरण के लिए जमीन उपलब्ध हो जाती है। जस्टिस कृष्णन रामासामी ने कहा कि जमीन अनुसूचित जाति (SC) के व्यक्तियों को गैर-SC/ST व्यक्तियों को हस्तांतरण के प्रतिबंध के साथ आवंटित की गई थी, लेकिन इस शर्त का उल्लंघन किया गया था।
