Consensual Intimacy Not Rape After Relationship Fails: Supreme Court
Business Standard · top
The Supreme Court has stated that consensual physical intimacy during a relationship cannot be retrospectively branded as rape if the alliance later sours. A bench noted a disturbing trend of criminal cases being filed after failed relationships, distinguishing between genuine deception and retrospective regret for past consensual acts. The court cautioned that treating every soured consensual relationship as rape dilutes the gravity of the actual offence. It emphasized that rape charges must be reserved for situations involving real sexual violence, coercion, or manipulation of consent.
